Sierra Club Wins Injunction to Halt Construction of 1st Phase of Legacy Highway.

On November 16th 2001, the 10th Circuit Court of Appeals in Denver granted plaintiffs opposing the Legacy Highway an injunction pending their appeal to stop all construction of the highway's Davis County phase. Arguments for the appeal are set to begin March 17th of 2001. The Sierra Club is seeking to overturn the August decision of the Utah District Court's ruling upholding the environmental analysis of the Legacy project. Plaintiffs claim that permits for the Legacy Highway are in violation of the Clean Water Act, Clean Air Act, and the National Environmental Policy Act. The Sierra Club is joined in the appeal by Utahns for Better Transportation and Salt Lake City Mayor Ross "Rocky" Anderson.
